How to Change Your Name Through Gazette Notification? A Step-by-Step Legal Guide

While minor spelling errors or small variations in names may sometimes be corrected through an affidavit and supporting documents, a complete change of name generally requires following a formal legal procedure. Step 1: Publish a Public Notice in Newspaper
Before applying for Gazette publication, the applicant is generally required to publish a public notice regarding the proposed change in a daily leading newspaper.
The newspaper notice should clearly mention the details of the name change, including:
Existing name;
New name;
Father's/Husband's name (where applicable);
Residential address; and
Declaration regarding the proposed change.
The original copy of the newspaper publication is required to be submitted along with the Gazette application.
Step 2: Prepare the Name Change Declaration/Affidavit
The applicant must prepare an undertaking or declaration stating the details of the name change.
The declaration should mention:
The existing name;
The new name proposed to be adopted;
Details of the applicant's father/husband (where applicable);
Complete residential address; and
A statement declaring that the information provided is true and correct to the best of the applicant's knowledge.
The declaration must be duly signed by the applicant and supported by two witnesses.
Step 3: Prepare the Gazette Application Documents
For publication of the public notice in the Gazette of India Part-IV, the applicant is required to submit the prescribed documents, which generally include:
Duly signed undertaking/declaration by the applicant;
Original newspaper containing the public notice;
Prescribed proforma in duplicate, duly typed and signed by the applicant and two witnesses;
Soft copy of the notice in MS Word format (CD);
Two self-attested passport-size photographs;
Self-attested copy of identity proof;
Certificate declaring that the hard copy and soft copy contain the same information;
Request letter along with prescribed publication fee; and
Supporting legal or medical documents, wherever applicable.
The documents should be properly prepared and self-attested before submission.
Step 4: Submission of Application for Gazette Publication
The complete set of documents along with the prescribed fee has to be submitted before the concerned authority for publication in the Gazette of India.
The application can generally be submitted personally or sent through post/courier as per the prescribed procedure.
Incomplete applications, unclear declarations, or notices containing incorrect information may be rejected by the concerned authority.
Step 5: Verification and Publication in Gazette
After receiving the complete application, the concerned department examines the documents and forwards the request for publication in the Gazette of India.
Once approved, the name change notice is published in Gazette of India Part-IV.
The applicant can thereafter download the published Gazette notification from the official e-Gazette portal.
How to Download Gazette Notification?
After publication, the applicant can search and download the Gazette copy by following these steps:
Visit the e-Gazette portal.
Select the Gazette search option.
Choose the category as Weekly Gazette.
Select Part-IV under the relevant section.
Enter the relevant date range.
Download the PDF file.
Use the search option (Ctrl + F) to find the old or new name.
Save a complete copy of the Gazette notification for future use.
The downloaded electronic Gazette copy can be used as proof of the published name change.
